Description

This course examines the different ways in which law regulates the political process in Australia, and situates that regulation in a theoretical and comparative context. It investigates how the constitutional and legislative framework shapes and controls the practice of politics in a range of areas, including elections, parties and political finance. In doing so, the course invites students to reflect on how the legal regulation of politics is informed by diverse (and sometimes competing) values, among them liberty, equality and deliberation. The course deals primarily with Australian law but draws on comparative material from the United States, the UK, Canada and other countries where appropriate. The course has a particular focus on electoral reform, and students will be encouraged to engage with contemporary debates on such matters as campaign finance, electronic voting, direct democracy and the representation of women and minorities in Parliament.
