Description

This course focuses on the variety of legal issues that are raised by commercial transactions involving intellectual property. With a strong emphasis on case studies and the practical application of the law, it will consider the intellectual property issues raised in mergers and acquisitions and public offerings; due diligence involving intellectual property; insolvency and intellectual property; and securitisation and taxation of intellectual property. The complex issue of valuation of intellectual property will also be considered in detail. The course will be of particular interest to commercial lawyers dealing with these types of issues, as well as researchers and research managers and others whose work requires a detailed understanding of commercial dealings involving intellectual property rights.

Recommended Prior Knowledge

This course assumes a working knowledge of intellectual property based on study at undergraduate level or through completion of the postgraduate course LAWS4017. You will be expected to have an overview of intellectual property law or to have read J. McKeough, A. Stewart and P. Griffith, Intellectual Property in Australia (3rd ed) (LexisNexis Butterworths, 2004) and J. McKeough, K. Bowrey and P. Griffith, Intellectual Property: Commentary and Materials (4th ed) (Thomson Law Book Co, 2007).

Graduate Diploma of Applied Intellectual Property students are expected to have a working knowledge of intellectual property based on study of the postgraduate course LAWS4046.

Course Objectives

A candidate who has successfully completed this course should:
  • Have a clear understanding of the intellectual property issues raised in a variety of commercial transactions
  • Have a strong awareness of the issues involved in and complexities of the issue of IP valuation
  • Be able to apply this knowledge both in a practical context through a case-study exercise
  • Be able to make cogent, well-developed arguments about some of the legal issues raised in the course though a research essay.
