Contemporary Legal & Social Theory: Jurgen Habermas 2 - LAWS4336 | |||||||||||||||||||||||||||||||||||||||||
Description This course follows directly on from Studies in Contemporary Legal and Social Theory - Jurgen Habermas 1 (LAWS4335) and will further develop the approach and themes covered in that course. Now, however, instead of focusing on Habermas's general theory of rationality, society and law as set out in The Theory of Communicative Action, we will focus on Habermas's more recent work Between Facts and Norms: Contributions to a Discourse Theory of Law and Democracy (1996) - a rich and detailed work that concentrates exclusively on law.
Recommended Prior Knowledge LAWS4335 Studies in Contemporary Legal and Social Theory - Jurgen Habermas 1. Students wishing to take this course and LAWS2333 Advanced Legal and Social Theory should consult the teacher of this course first since there is some overlap and special arrangements will have to be made with respect to assessment.
