Description Introduces the aims, objectives and practice of comparative law, and the strengths and limitations of such an inquiry by focusing on aspects of criminal trial practice in various jurisdictions. Critically evaluates our criminal trial process by focusing on a number of themes, including: Bill of Rights; understanding adversarialism and accusatorial justice; inquisitorial or adversarial; transplanting legal cultures; confessions and the right to silence; plea bargaining; jury decision-making and controlling prejudice; double jeopardy.
