Description

What is the rule of law and how is it different from arbitrary power? What are and what should be the limits of state power and individual freedom? Explores these and other conceptual and normative issues in the philosophy of law, including the nature of law, the relation of law to violence and justice, and the task of legal philosophy. Contemporary approaches and thinkers examined may include the following: positivists such as Hart and Kelsen, natural lawyers such as Fuller, liberal and rights theorists including Mill and Dworkin, and critical thinkers such as Schmitt, Derrida and Foucault.
