Description

The aim of this course is to provide a framework for understanding the environmental issues which humans are faced with today and the implications of these issues for law making and policy. Within that framework this course will provide you with an introduction to key areas of environmental law in New South Wales and at a federal level. The course will cover a range of specific topics outlined below and will explore a number of cross-cutting themes that influence current debate in relation to environmental law and policy, including:
  • ecologically sustainable development;

  • inter-generational equity;

  • the precautionary principle; and

  • conservation of biological diversity.
The key topics addressed in this course include:
  • the origins and development of environmental law;

  • the functions and structure of environmental law;

  • international environmental law;

  • federal environmental law;

  • environmental planning law;

  • development assessment law;

  • threatened species law;

  • protected areas law;

  • native vegetation law;

  • water management law;

  • heritage protection law; and

  • pollution control law.
The course will aim to place relevant legal principles in their social and political context, and to encourage critical analysis and the development of practical skills through the use of case studies, class discussion and practical exercises. Recent developments in the relevant laws will also be discussed.
