Description

This course provides a contextual examination and critical analysis of the principal features of federal regulation of workplace relations in Australia, following the enactment of the Workplace Relations Amendment (Work Choices) Act 2005. Topics covered include:

- A critical examination of the political and economic motivations for the reforms
- Constitutional implications (including the impact of the reforms on the States)
- New institutional arrangements
- The new "safety net" (including the Australian Fair Pay and Conditions standards, and the continuing role of awards)
- Workplace bargaining (individual and collective)
- Controls on industrial action
- The regulation of industrial associations
- Implications for corporate restructuring (transmission of business rules; termination of employment protections)
- Dispute resolution

The focus of the course will be to understand the implications of the new regime for a range of labour market participants, including employers, workers and unions.
