Description

The course will consider the international investment legal order as it applies to and operates at the international, transnational and domestic levels. Specifically, this course will consider the whole array of international investment law instruments, regulations, treaties and practices that impact the field, with particular focus on those relevant to Australia and the Pacific region. The course will survey a range of issues from the field which may include international investment law agreements (multilateral and bilateral ("BITS"), international investment law dispute resolution mechanisms (including the ICSID, NAFTA Chapter 11, ICC arbitration, Asian investment resolution mechanisms and institutions, and domestic lititgation issues relevant to investment disputes) and issues related to the creation and implementation of foreign direct investments (negotiations, regulatory compliance, project finance, etc).
