Description

The Course will cover topics in property law that are directly relevant to legal practice but not typically covered in undergraduate law courses. They include: commercial, retail and residential leases; freehold covenants; strata and community title; new and emerging forms of property consequent on technological and social change. There may also be some in-depth focus on the most important recent legislative developments and case law in general property law. The course will also examine how changes in legal rules bear on the concept of property.

Course Objectives

A candidate who has successfully completed this course should be able to:
  • Incorporate into arguments about controversial issues in property law an understanding of the role that property law plays within the legal system
  • Understand the purpose of, and apply to factual scenarios, important property legislation, including the Retail Leases Act 1994, Residential Tenancies Act 1987, Strata Schemes (Freehold Development) Act 1973, Strata Schemes (Leasehold Development) Act 1986., Strata Schemes Management Act 1996
  • Engage in decates about the appropriate scope of property law (for example, the objects to which property concepts ought to be applicable)

Class Participation                        20%
Research Essay
